Terms of Service

These Terms of Service ("Terms") govern your use of the website at atlasassetsolutions.com, the Atlas client portal, and the software applications operated by Atlas Asset Solutions LLC ("Atlas," "we," "us") (together, the "Services"). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Information only, not legal advice

Content on this website is general information about the property-insurance appraisal process. It is not legal advice, and it is not a substitute for reading your own insurance policy. Atlas is not a law firm. Appraisal generally addresses the amount of a loss, not whether a loss is covered. For coverage or other legal questions, consult a licensed attorney.

2. No engagement without a signed agreement

Contacting us through the website, by email or by phone does not create a client relationship or obligate either of us to anything. We are engaged only when you and Atlas sign a written engagement agreement, which will set out the scope of work and the fees. If anything in these Terms conflicts with a signed engagement agreement, the engagement agreement controls for that engagement.

3. No guaranteed outcome

Every claim, policy and property is different. Atlas does not promise or guarantee any particular appraisal award, settlement amount or timeline, and past results do not predict future outcomes.

4. Client portal and application accounts

• You are responsible for keeping your login details and any links we send you confidential, and for activity under your account.
• Upload only documents and information that you have the right to share and that relate to your claim.
• Tell us promptly at frankie@atlasassetsolutions.com if you believe your account or a portal link has been misused.
• We may suspend or end access to protect the Services, our clients or others, or when an engagement ends.

5. Connected Google accounts

Some Atlas applications let you sign in with Google or connect a Google account. When you do, you authorize the application to access the Google data you approve, for the purposes described in our Privacy Policy. You can revoke that access at any time at myaccount.google.com/permissions. Your use of Google services remains subject to Google's own terms.

6. Acceptable use

You agree not to:

• use the Services for anything unlawful, fraudulent or misleading, including submitting false claim information;
• try to gain unauthorized access to the Services, other accounts, or our systems or data;
• interfere with or disrupt the Services, or upload malware or harmful code;
• scrape, copy or resell the Services or their content without our written permission.

7. Our content

The Services, including text, design, logos and software, are owned by Atlas or its licensors and are protected by law. You may view and print pages for your personal, non-commercial use. Documents and photos you provide remain yours; you give us permission to use them to provide our services to you.

8. Third-party services and links

The Services may rely on or link to third-party services, such as Google, Cloudflare and Web3Forms. We are not responsible for third-party services, content or practices, which are governed by their own terms and policies.

9. Disclaimer

The Services are provided "as is" and "as available." To the fullest extent permitted by law, Atlas disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or secure.

10. Limitation of liability

To the fullest extent permitted by law, Atlas will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the website, portal or applications. Our total liability for any claim relating to the use of these Services will not exceed one hundred U.S. dollars (US$100). This section does not limit any obligation we have under a signed engagement agreement or any liability that cannot be limited by law.

11. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Services will be brought in the state or federal courts located in Tarrant County, Texas, and you consent to their jurisdiction.

12. Changes

We may update these Terms from time to time. We will post the updated version on this page and change the "Last updated" date. Continuing to use the Services after an update means you accept the updated Terms.
